Last Updated: April 2nd, 2026 These Terms of Service (“Terms”) govern your access to and use of the NexaID identity attestation infrastructure, including the NexaID website, browser extension, APIs, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

Definitions

NexaID” or “Service means the blockchain-based identity attestation infrastructure operated by NexaID that enables users to generate and submit cryptographic proofs relating to certain attributes or account ownership to supported third-party applications. User means any individual or entity that accesses or uses the NexaID interface, plugins, APIs, or related services. Attestation means a cryptographic statement generated through the NexaID system confirming that a specified condition or attribute has been verified through supported authentication methods. Proof means a cryptographic proof generated by the NexaID system (including zero-knowledge proofs where applicable) demonstrating that a user satisfies certain conditions without revealing the underlying data. Third-Party Application means any website, application, protocol, or platform operated by a third party that integrates NexaID through APIs, SDKs, plugins, or other technical interfaces. User Data means information provided by the user during authentication processes with third-party services; provided that NexaID does not collect, store, or control such information unless explicitly stated. Authentication Source means any external platform or service used to verify user attributes or account ownership, such as social media platforms, wallets, or other digital identity providers. Plugin means any browser extension, software component, or integration that allows a user to generate and submit proofs through the NexaID system.

Description of the Service

NexaID provides a technical infrastructure that enables users to generate and present cryptographic attestations regarding certain claims derived from third-party online services. The Service may include tools that allow users to:
  • connect to third-party websites or online services through a browser extension or other user-side interface;
  • generate zero-knowledge or other cryptographic proofs based on user interactions with such third-party services;
  • obtain attestations that can be verified by third parties through NexaID’s verification infrastructure.
The Service is designed to enable users to prove specific attributes or claims without directly disclosing underlying personal data.

User Responsibilities

When using the Service, you agree that:
  • you will use the Service only for lawful purposes;
  • you will not attempt to manipulate, falsify, or improperly generate attestations;
  • you will not exploit vulnerabilities or security flaws in the Service;
  • you will comply with all applicable laws and regulations when using the Service.
You remain solely responsible for the claims you generate or present through the Service.

Browser Extension and User-Side Software

Certain features of the Service may require the installation or use of browser extensions or other user-side software (“Extension”). The Extension operates on the user’s own device and interacts directly with third-party services. NexaID does not control the behavior of third-party websites or services accessed through the Extension. You are responsible for maintaining the security of your devices and accounts when using the Extension.

Disclaimers

No Warranty The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, NexaID makes no representations or warranties regarding:
  • the accuracy or validity of any attestation generated through the Service;
  • the availability or uninterrupted operation of the Service;
  • the security of third-party services;
  • the suitability of the Service for any specific purpose.
No Identity Verification or KYC NexaID provides cryptographic attestation infrastructure designed to enable users to generate proofs relating to certain attributes or account ownership. NexaID does not perform identity verification, know-your-customer (KYC), or background checks on users. Any attestations or proofs generated through the Service do not constitute confirmation of a user’s real-world identity, legal status, or compliance with regulatory requirements. No Guarantee of Accuracy NexaID does not guarantee the accuracy, completeness, reliability, or validity of any information, attestations, or proofs generated through the Service. Such attestations depend on authentication sources, user-provided inputs, and third-party systems which are outside NexaID’s control. Users and third-party applications relying on NexaID attestations do so at their own risk. Third-Party Services The Service may interact with or rely upon third-party services, platforms, authentication providers, wallets, or blockchain networks. NexaID does not control and is not responsible for the availability, functionality, security, or policies of any such third-party services. Any interaction between users and third-party applications is solely between those parties. No Responsibility for User Decisions NexaID does not endorse, verify, or assume responsibility for any decisions, transactions, or actions taken by users or third-party applications based on attestations or proofs generated through the Service. Any reliance on the Service for eligibility, access control, governance participation, or financial activity is undertaken at the user’s own risk. Blockchain and Smart Contract Risks The Service may interact with blockchain networks, smart contracts, and cryptographic systems. These technologies are experimental and may contain vulnerabilities or errors. NexaID does not guarantee that the Service will be secure, uninterrupted, or free from bugs, exploits, or technical failures. No Custody of Assets or Personal Data NexaID does not custody user digital assets, private keys, or authentication credentials. Except as explicitly stated, NexaID does not collect or store users’ personal information obtained through authentication sources. NexaID is a non-custodial infrastructure provider and does not hold or control user funds, credentials, or authentication accounts. Users are solely responsible for the security of their devices, wallets, and authentication accounts. Informational Nature of Attestations Attestations and proofs generated through NexaID are informational and technical in nature. They should not be interpreted as certifications, guarantees, legal assurances, or endorsements by NexaID. Third-party applications integrating NexaID remain solely responsible for determining how such attestations are used. No person should rely on any attestation generated through NexaID as a substitute for independent verification. Regulatory Compliance Users and third-party applications are solely responsible for determining whether their use of the Service complies with applicable laws and regulations in their respective jurisdictions. NexaID does not represent or warrant that the Service is appropriate or lawful in all jurisdictions. Open Source and Third-Party Software The Service may incorporate open-source software or other third-party components. Such components may be subject to separate license terms. NexaID does not warrant the performance or security of third-party software components.

Limitation of Liability

To the fullest extent permitted by applicable law, NexaID and its affiliates, directors, officers, employees, agents, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to the use of, or inability to use, the Service. Without limiting the foregoing, NexaID shall not be liable for any loss of profits, loss of data, loss of digital assets, loss of reputation, business interruption, or other economic losses resulting from the use of the Service, even if NexaID has been advised of the possibility of such damages. Users acknowledge that the Service interacts with blockchain networks, cryptographic systems, browser plugins, and third-party authentication sources, all of which may involve inherent technical risks. NexaID shall not be responsible for losses arising from network failures, smart contract vulnerabilities, software errors, malicious attacks, or unauthorized access to user accounts or devices. To the maximum extent permitted by law, NexaID’s total aggregate liability arising out of or relating to the Service shall not exceed the greater of: (i) the amount paid by the user (if any) for the use of the Service in the twelve (12) months preceding the event giving rise to the claim; or (ii) one hundred U.S. dollars (USD 100). Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, NexaID’s liability shall be limited to the maximum extent permitted by applicable law.

Indemnification

Users agree to indemnify, defend, and hold harmless NexaID, its affiliates, directors, officers, employees, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) the user’s access to or use of the Service; (b) the user’s violation of these Terms; (c) the user’s violation of any applicable laws or regulations; (d) any misuse of attestations, proofs, or outputs generated through the Service; or (e) any interaction between the user and third-party applications or services that integrate NexaID. Users acknowledge that NexaID acts solely as a technical infrastructure provider for cryptographic attestations and does not control how third-party applications rely on or interpret such attestations. Users remain solely responsible for their use of the Service and any consequences arising from such use. NexaID reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by the user, in which case the user agrees to cooperate fully with NexaID in asserting any available defenses.

Intellectual Property

All rights, title, and interest in and to the Service, including but not limited to the NexaID platform, software, APIs, SDKs, documentation, interfaces, designs, trademarks, logos, and underlying technology, are owned by NexaID or its licensors and are protected by applicable intellectual property laws. Subject to these Terms, NexaID grants users a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for its intended purposes. Users shall not copy, modify, distribute, sell, sublicense, reverse engineer, decompile, or otherwise attempt to extract the source code or underlying technology of the Service, except to the extent permitted by applicable law. Any feedback, suggestions, or ideas provided by users regarding the Service may be used by NexaID without restriction and without any obligation to compensate the user. Nothing in these Terms grants users any ownership rights in the NexaID platform or related intellectual property.

Suspension or Termination

NexaID may suspend or terminate access to the Service if:
  • a user violates these Terms;
  • the Service is used in a manner that may harm the platform or other users;
  • required by applicable law or regulatory requirements.
NexaID may also modify, suspend, or discontinue the Service at any time.

Changes to the Terms

NexaID may update these Terms from time to time. If material changes are made, NexaID will provide notice through the website or other reasonable means. Continued use of the Service after the updated Terms become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms and any dispute arising out of or relating to the Service shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Service shall be resolved through good faith negotiations between the parties. If such dispute cannot be resolved within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of Hong Kong. Nothing in these Terms shall prevent NexaID from seeking injunctive or equitable relief in any court of competent jurisdiction where necessary to protect its intellectual property or confidential information.

Developer API Terms

Scope of Services These Developer API Terms (“Developer Terms”) govern the access to and use of NexaID’s application programming interfaces, verification tools, and related services (collectively, the “Developer API”) by developers, platforms, or other service providers (“Developer”). The Developer API enables Developers to verify cryptographic attestations generated through the NexaID infrastructure. NexaID provides technical verification tools only and does not participate in the Developer’s business operations, customer onboarding processes, or regulatory compliance activities. Nature of the Service The Developer acknowledges and agrees that NexaID provides a technical attestation and verification infrastructure only. The Service:
  • does not perform identity verification;
  • does not conduct KYC, AML, or regulatory due diligence;
  • does not verify the real-world identity of any user.
Attestations verified through the Developer API merely confirm the validity of a cryptographic proof generated through the NexaID system. The Developer is solely responsible for determining whether such attestations are sufficient for its own operational, business, or compliance purposes. Developer Responsibilities The Developer agrees that it is solely responsible for:
  • complying with all applicable laws and regulations in connection with its use of the Developer API;
  • implementing any required identity verification, KYC, AML, or customer due diligence procedures;
  • determining how attestations generated through the NexaID infrastructure are used within its services.
The Developer shall not represent NexaID as performing identity verification, KYC, AML screening, or regulatory compliance functions. Prohibited Uses The Developer shall not use the Developer API:
  • as a substitute for legally required identity verification or regulatory compliance procedures;
  • in any manner that violates applicable laws or regulations;
  • in connection with unlawful, fraudulent, or deceptive activities;
  • in a way that attempts to manipulate or falsify attestations.
NexaID reserves the right to suspend or terminate API access if the Developer uses the Service in violation of these terms. Fees and Payment Fees for the Developer API (if any) shall be agreed separately between NexaID and the Developer. Unless otherwise agreed in writing:
  • all fees are non-refundable;
  • NexaID may update pricing or billing structures with reasonable notice.
The Developer is responsible for all charges associated with its use of the Developer API. API Usage and Technical Limits The Developer must use the Developer API in accordance with NexaID’s technical documentation. NexaID may implement reasonable limitations on API usage, including:
  • rate limits;
  • access restrictions;
  • service quotas.
These limitations are intended to protect the integrity and stability of the Service. NexaID may suspend or terminate Developer API access in accordance with the main Terms of Service. The disclaimers, limitations of liability, and indemnification provisions in the main Terms of Service apply equally to the Developer API.
